Aqube Outdoor User Agreement
1. About this Agreement
Welcome to Aqube Outdoor.
This Agreement is entered into between you and Suzhou HyECO Smart Co.Ltd (“we,” “us,” or “our”) concerning your registration for, sign-in to, and use of the Aqube Outdoor mobile application, consumer Web application, installer Web application, and related device-connectivity, cloud, and customer-support services (collectively, the “Services”).
Please read and fully understand this Agreement before using the Services, particularly provisions highlighted in bold or by another reasonable method concerning limitations of liability, device safety, account management, and dispute resolution. By clicking to agree, registering or signing in, or actually using the Services, you acknowledge that you have read and agreed to this Agreement.
If you do not agree, stop registering for or using the Services.
2. Scope and related rules
- This Agreement applies to the Aqube Outdoor mobile application, consumer Web application, and installer Web application currently provided.
- This Agreement, the Aqube Outdoor Privacy Policy, in-product operating and safety notices, device manuals, and any special rules we lawfully publish together govern your use of the Services.
- If a special rule conflicts with this Agreement, the special rule prevails within its expressly stated scope, unless mandatory law provides otherwise.
- Device capabilities may vary by model, firmware version, region, network environment, or account permission. The actual product interface and device documentation control.
3. Account registration and security
- Aqube Outdoor currently provides account services primarily through email registration, verification codes, password sign-in, and password recovery. Another sign-in method may be used only after it is actually launched and clearly described.
- You must provide truthful, accurate, and complete information and keep it current. You must not register using another person’s identity, organization, or contact details.
- You are responsible for appropriately safeguarding sign-in credentials, verification codes, passwords, local device PINs, and signed-in terminals. You bear corresponding responsibility under applicable law for loss caused by your voluntary disclosure, transfer, lending, or unreasonable failure to safeguard them.
- If you discover unauthorized access to or control of an account, garden space, or device, immediately change your password, revoke the relevant member permissions, and contact us using the details in this Agreement.
- To protect account and device security, we may reasonably use identity verification, risk warnings, restrictions on high-risk operations, suspension of abnormal sessions, and similar measures.
- Signing out ends only the current account session. It is not account deletion and does not automatically delete cloud account data, garden data, or local device data.
4. Services
Subject to the supported device model, account role, and product version, the Services may include:
- Creating and managing gardens, areas, and members;
- Adding, provisioning, binding, viewing, controlling, and removing smart lights, light strips, multi-channel controllers, irrigation controllers, and other devices;
- Creating and running groups, scenes, schedules, DIY effects, irrigation programs, and other automations;
- Viewing device state, execution records, irrigation history, and service records;
- Communicating with devices over Bluetooth, a local network, the internet, or a device-cloud service;
- Inviting installers or installation organizations to perform installation, commissioning, service-record management, and ownership handover;
- Providing fault diagnosis, log export, customer support, and security maintenance;
- Other functions expressly presented in the product.
We may adjust specific functions based on applicable law, device capabilities, security requirements, and operating arrangements. We will lawfully notify you through the product, a message, or another appropriate method of a change that materially affects user rights.
5. Garden roles, member permissions, and ownership handover
- Garden members may include an owner, regular user, and guest. Available operations vary by role and are determined by the product’s actual permission configuration.
- A garden owner may invite or remove members and change permissions, and must ensure invitations and permission allocations are lawful and necessary. You must not grant device-control access to another person without authorization.
- An installation-service account is used for installation, commissioning, or after-sales service and does not automatically obtain garden ownership or full device-control rights. Installers may access relevant information only with user authorization and to the extent necessary to provide the service.
- After an ownership handover, the recipient becomes the new garden owner and the former owner may become a guest. The system may currently apply a protection period of approximately 24 hours to reduce erroneous or malicious repeated transfers; the product notice controls.
- Ownership handover is an important operation. Both parties must verify the account, device, garden, and member information. The responsible party bears the consequences under applicable law of entering the wrong recipient account, granting excessive permissions, or failing to revoke permissions promptly.
6. Device control and safe use
- Actual smart-device execution may be affected by power, network service, Bluetooth connection, device firmware, sensor state, installation quality, and the on-site environment. A status such as “sent” or “executed” in the application does not establish that the physical environment is completely safe.
- Use devices in accordance with their manuals, installation requirements, and local law, and confirm on-site conditions before irrigation, electrical wiring, lighting control, scheduled operations, or remote control.
- For an operation that could cause personal injury, water leakage, property damage, or an impact on others or public facilities, apply reasonable safeguards and perform necessary on-site checks. Do not rely solely on remote control, automated scenes, or schedules.
- Do not bypass a device protection mechanism, unlawfully crack or modify firmware, falsify a device identity, interfere with communications, or control a device you are not authorized to manage.
- Removing a device from Aqube Outdoor generally removes its in-application garden association and cleans up the relevant cloud or local business data. It is not the same as a factory reset and does not necessarily remove the device entity from an upstream device-cloud platform. Follow the device manual before transfer, disposal, or rebinding.
- For delay, interruption, or failure caused by force majeure, carrier networks, third-party cloud services, offline devices, system maintenance, or the user’s on-site environment, we bear responsibility according to fault and actual impact to the extent permitted by law.
7. Acceptable use
When using the Services, you must not:
- Violate applicable law, public order, or generally accepted standards of conduct;
- Infringe another person’s privacy, personal information, intellectual property, property, or other lawful rights;
- Access, control, transfer, or share another person’s account, garden, or device without authorization;
- Upload or submit false, unlawful, infringing, malicious, or system-threatening content;
- Reverse engineer, maliciously scan, attack, scrape, or interfere with the Services, or evade access controls or security measures, except to the extent expressly permitted by law;
- Use the Services for fraud, device damage, cybersecurity harm, or another unlawful activity;
- Occupy systems, interfaces, or network resources beyond normal use.
If you violate these requirements, we may, depending on the conduct, issue a warning, limit functionality, suspend service, terminate the account, preserve evidence, report to a competent authority, or pursue responsibility in accordance with law.
8. User content and intellectual property
- You retain your applicable rights in avatars, names, area photos, scene names, device notes, and other user content to which you lawfully hold rights.
- To provide storage, display, synchronization, sharing, troubleshooting, and customer support, you grant us the permission necessary to process that content within the scope of the Services. This permission is limited to providing the Services and does not transfer ownership to us.
- The Aqube Outdoor software, interface, trademarks, graphics, documentation, code, and related intellectual property belong to us or their lawful rightsholders. Without authorization, you may not copy, sell, rent, license, or commercially distribute them.
- If you believe content in the Services infringes your lawful rights, send proof of your rights and a specific explanation using the contact details in this Agreement, and we will handle the matter in accordance with law.
9. Third-party products and services
- The Services may depend on operating systems, application stores, cloud infrastructure, device-cloud platforms, maps, network services, or other third-party capabilities.
- Third-party services are provided under the relevant provider’s rules. We will lawfully select partners and take reasonable security-management measures, but independently provided third-party products or services may remain subject to their own terms.
- Where information is collected directly by a third party or you are redirected to a third-party page, we will provide a clear notice where practicable. Read the applicable rules before use.
10. Fees
- The core account and device-management functionality reflected in the current code does not include in-application purchases, subscriptions, or payment flows.
- If paid services are added in the future, we will clearly present the service, price, billing period, refund or cancellation rules, and obtain your separate confirmation before purchase.
- Network-data, text-message, or carrier charges resulting from use of the Services are settled between you and the applicable provider under its rates.
11. Changes, interruption, and termination
- We may suspend part of the Services for maintenance, upgrades, security fixes, or device adaptation and will provide advance notice where practicable.
- If you materially breach this Agreement, endanger account or device security, or applicable law or a competent authority requires the Services to stop, we may take necessary restriction or termination measures.
- You may stop using the Services, sign out, or request account deletion. If a complete in-application deletion entry is not yet available, you may submit a request to info@aqubeiot.com. We will verify your identity and process the request within 15 business days in accordance with law.
- After account deletion, we will delete or anonymize related personal information in accordance with applicable law and the Aqube Outdoor Privacy Policy, except information that must be retained by law and on-site device or terminal data that was not synchronized with the account.
- Termination does not affect rights and obligations accrued before termination or release either party from responsibility it must bear under applicable law.
12. Disclaimers and limitations of liability
- We apply technical and organizational measures appropriate to the Services to protect stability and security, but cannot guarantee uninterrupted service, connection of every device in every environment, or execution of every automation instruction as expected in every circumstance.
- You bear corresponding responsibility under applicable law for loss caused by violating device instructions, installation requirements, safety notices, or the scope of your authorization.
- We do not rely on this Agreement to exclude or limit liability that we must bear under applicable law for our intentional misconduct or gross negligence, infringement of personal rights, or another circumstance in which exclusion or limitation is prohibited.
- No limitation of liability affects a consumer’s statutory rights under applicable law.
13. Use by minors
Aqube Outdoor is primarily intended for adults with full civil capacity. A minor should use the Services only with the guidance and consent of a parent or other guardian. Device installation, electrical work, irrigation control, and other potentially hazardous functions must be operated or supervised by an adult.
14. Updates and notices
- We may update this Agreement because of changes in laws, product functionality, or business models.
- For a material change affecting user rights, we will provide notice through the application, a website announcement, email, or another appropriate method and obtain renewed consent where required by law.
- The updated Agreement will state its last-updated and effective dates. You may stop using the Services or request account deletion before it takes effect. Continued use after it takes effect constitutes acceptance of the lawfully effective update.
15. Governing law and dispute resolution
- The formation, performance, interpretation, and dispute resolution of this Agreement are governed by the laws of mainland China.
- The parties should first attempt to resolve a dispute through friendly consultation. If consultation fails, either party may bring proceedings before a court with lawful jurisdiction.
- This section does not prevent a consumer from seeking relief or submitting a complaint or report to a consumer association, market-regulation authority, or another competent authority under applicable law.
